Apparently, the captured data from Parler was previously publically available so there should be no legal issues here. The plan is to eventually post it on archive.org.
Rather than impeachment or the 25th Amendment, some have suggested using Section 3 of the 14th Amendment. Passed after the Civil War, Section 3 prevents the holding of Federal Office by those who have engaged in insurrection against the Constitution. Only a simple majority is required by both houses. If Trump wants to run for President in the future, he would need a re-vote and get 2/3 approval in both houses.
I still do not understand why Mike Pence is against the 25th. Trump never once inquired about Pence's well-being during the attempted coup after being loyal to him for 4 years. Personally, I would not protect someone who incited a crowd into wanting to hang me.
Joe Biden is not in favor of impeachment because the process takes too long which would affect the start of his presidency. He would rather have the Senate use the time to approve his cabinet nominees. This is also the reason why there is talk about delaying the Senate trial for months.
Saying that if Trump is not criminally liable if he essentially is not the pulling the trigger is not quite accurate in my opinion. If that were the case, gang leaders would never see a courtroom. I also do not believe Brandenburg v. Ohio applies here as what Trump did was actually direct his mob to the Capitol and tell them to be bold and "take back our country". But even if every jury refuses to convict him criminally, there will still be families and their lawyers seeing a deep pocket and having no problem going the civil route.
According to CNN, 2 Capitol Officers are under suspension and 10-15 are under investigation. Stay tuned.
What will be interesting is how the Republicans will spin the coup attempt now and in the future just to avoid the truth which is Don the Con spending months perpetuating a lie that eventually got out of hand.
